Este texto construye una versión de la teoría de Hegel acerca de la sanción penal, principalmente a partir de su Fundamentos de la Filosofía del Derecho, como una teoría agnóstica da la pena. El texto demuestra como la contradicción interna presentada por Hegel en cuanto el filósofo intenta resolver los problemas acerca de la punición no son resueltas, pero, por el contrario, como esas contradicciones necesariamente se integran a todo posible concepto o imposición de la sanción criminal.

O objetivo deste trabalho é apresentar a filosofia de Kant e o pensamento de Bohr como formas de conhecimento que se encontram, segundo alguns comentadores, a partir de conceitos da física clássica. Ademais, a epistemologia de Kant apresentou grande aproximação com a filosofia natural de Newton e, conceitualmente, alguns limites de fronteira com a filosofia da física quântica, se consideramos a fase inicial da mecânica clássica. Tais conceitos limítrofes adquiriram forma na física de Bohr e, por sua vez, se modificaram (...) no pensamento do físico dinamarquês. Assim, aborda-se aqui a posição de Bohr sobre conceitos aproximados da filosofia kantiana, pelo viés clássico da preservação de conceitos como espaço, tempo, realismo e causalidade da física. Por outro lado, serão apresentados argumentos que indicam como não se sustentam todas as interpretações que construíram um “Bohr kantiano”. (shrink)

Patriotism is not commonly associated with freedom. Even less so when Hegel is evoked. By reading Hegel’s concept of patriotism through the lens of revolutionary France, I present a notion of patriotism that is tied to the realization of freedom. This paper demonstrates what happens when Hegel’s philosophy of law is re-read through the political philosophy of the French Revolution itself. Hegel’s Philosophy of Right and its lectures are marked by tensions. The legacy it leaves traces it leaves behind can (...) be re-appropriated to explore the inconclusive hints left by the philosopher. The idea of patriotism is one of them, simply defined as an intersubjective link between the concrete individual and the state or as particular and general interests coinciding. This paper expands this analysis by introducing two elements: Hegel’s discussion on the character of the law and how it comes to be law; and the revolutionary phenomenon itself. The revolutionaries’ views on patriotism and its functions within a revolutionary moment can help us transform the mere traces left by Hegel into a wider vision that incorporates and promotes freedom. Honneth afirma que o léxico das palavras diagnóstico e patologia estão ligadas à medicina. Na área social, essas noções só podem ser interpretadas indiretamente, ou seja, através das narrativas literárias, do campo artístico e da cinematografia. O Observatório Global de Patologias Sociais propõe-se a superar esse déficit. Este artigo exibe não apenas a análise conceitual, mas também as percepções inovadoras oriundas de um questionário online. Foram três questões. Por um lado, trata-se de descrever uma conceptualização de patologia social. Por outro, (...) coletar sugestões para um instrumento empírico. Por fim, obter uma lista de patologias sociais. A análise demonstrou que há patologias restritas ao âmbito individual, enquanto outras são concernentes ao espaço coletivo. Nesse sentido, os efeitos e acometimentos também obedecem a categorias diferenciadas. Além do mais, aparecem percepções de patologias ligadas ao aspecto institucional, revelando uma preocupação com relação ao sistema social. Como conclusão, o texto sugere que a análise das patologias deve voltar-se à concretização social, institucional e histórica. Deste modo, os impulsos que, a princípio, eram tratados como subjetivos, individuais ou pessoais podem ser investigados como situações sociais coletivas e institucionais. (shrink)

La historia de las teorías de la argumentación es, en términos generales, la historia de la evolución del uso de estructuras, procedimientos y recursos y, probablemente por eso mismo, subsisten en ella todavía algunos problemas no resueltos como la periodización, la conceptualización, los índices descriptores y si debemos hablar de varias teorías o de una sola construida con diversos aportes a lo largo de la tradición. En las páginas que siguen enunciamos estos problemas, proponemos una ampliación para uno de los (...) esquemas clásicos de periodización y nos centramos fundamentalmente en presentar algunos elementos relevantes que permitan trazar una imagen del primero de estos períodos, conocido como “fundacional”. The history of argument theories is, in general, the history of the evolution of the use of structures, procedures and resources. Probably due to that, some unresolved problems such as periodization, conceptualization, descriptor indices, and whether we should talk about one or several theories built upon different contributions along the tradition, still remain. In this paper, we state these problems, propose an extension to one of the classical periodization schemes, and focus primarily on presenting some relevant elements in order to draw a picture of the first of these periods known as “foundational”. O artigo reflete sobre os modos como os discursos constituem realidades sociais e subjetividades nos processos de lutas simbólicas e materiais por imposição de significados e discute os modos como uma professora negra organiza microlutas discursivas na tentativa de constituir-se enquanto sujeito. Para tanto, utilizam-se os estudos foucaultianos para analisar o fenômeno do poder e as técnicas de resistência a esses fenômenos.

No cartesianismo contemporâneo, devido à retomada da teoria da livre criação das verdades eternas, alguns intérpretes trazem ao debate internacional um interessante viés interpretativo do pensamento de Descartes. Segundo eles, ao apresentar a indiferença da vontade como atributo de Deus, Descartes instaura uma concepção totalmente perigosa, da qual derivam a incompatibilidade entre a indiferença divina e o sistema cartesiano, deflagrando, enfim, um irracionalismo radical.

En este artículo damos cuenta de las propuestas de grafemarios -más conocidas y diferenciadas entre sí- para escribir la lengua mapuche y discutimos sus fundamentos y las tensiones que subyacen en ellas. Con ello esperamos contribuir a abrir la actual discusión para una toma de conciencia de las alternativas posibles, de las representaciones que se encuentran en disputa y de lo que generan estas concreciones cuando se llevan al plano de la educación intercultural. La aparición de grafemarios mapuche huilliches y (...) la defensa de unos y resistencia a otros muestra que incluso en aquellas zonas aparentemente más “objetivas y técnicas” de la lengua lo político tiene lugar, evidenciando que lo lingüístico está irrenunciablemente atado a las relaciones de poder que involucran a los sujetos y a las comunidades de habla. In this paper, we discuss some of the different and best known grapheme alphabet proposals for writing the Mapuche language, and discuss their rationale and the tensions that underlie them. With this, we hope to contribute to open the current debate to a new awareness of possible alternatives about the representations that are in dispute and about what these concretions generate when they are used in intercultural education. The appearance of Mapuche Huilliche grapheme alphabets, the adoption of some of them and the resistance to others show that even in language areas seemingly more “objective and technical”, politics takes place. The enhanced mathematical indispensability argument, proposed by Alan Baker (2005), argues that we must commit to mathematical entities, because mathematical entities play an indispensable explanatory role in our best scientific theories. This article clarifies the doctrines that support this argument, namely, the doctrines of naturalism and confirmational holism.

The crucial problem of self-consciousness is how to account for knowing self-reference without launching into a regress or without presupposing self-consciousness rather than accounting for it. In the literature we find two bottom-up proposals for solving the traditional problem: the postulation of nonconceptual forms of self-consciousness and the postulation of a pre-reflexive form of self-consciousness. However, none of them seems satisfactory for several reasons. In contrast, I believe that the only way of solving this traditional puzzle is to assume another (...) bottom-up approach, namely the one that accepts Baker’s challenge to naturalism and provides a naturalist framework for self-consciousness; in Baker’s terms, to account for self-consciousness in non-intentional, non-semantic, and non-mental terms. That is the aim of this paper. My thesis rests on two claims. The first is the metaphysical claim that every creature enjoys a fundamental relation to itself, namely identity. The second is Dretske’s epistemological claim that representations do not require a Self, traditionally understood as the principle that spontaneously organizes mental activity and lies behind all intentional acts. Briefly, I argue for a naturalization of self-consciousness that postulates non-linguistic, naturalized, and selfless form of representation of the cognitive system based on the metaphysical, fundamental relation everyone has to himself, namely identity. Self-consciousness emerges when brain states are selflessly recruited through learning to represent the cognitive system itself as a subject. (shrink)

Maximize Expected Choiceworthiness (MEC) is a theory of decision-making under moral uncertainty. It says that we ought to handle moral uncertainty in the way that Expected Value Theory (EVT) handles descriptive uncertainty. MEC inherits from EVT the problem of fanaticism. Roughly, a decision theory is fanatical when it requires our decision-making to be dominated by low-probability, high-payoff options. Proponents of MEC have offered two main lines of response. The first is that MEC should simply import whatever are the best solutions (...) to fanaticism on offer in decision theory. The second is to propose statistical normalization as a novel solution on behalf of MEC. This paper argues that the first response is open to serious doubt and that the second response fails. As a result, MEC appears significantly less plausible when compared to competing accounts of decision-making under moral uncertainty, which are not fanatical. (shrink)

I argue against pessimistic readings of the Buddhist tradition on which unawakened beings invariably have lives not worth living due to a preponderance of suffering (duḥkha) over well-being.

According to comparativist theories of quantities, their intrinsic values are not fundamental. Instead, all the quantity facts are grounded in scale-independent relations like "twice as massive as" or "more massive than." I show that this sort of scale independence is best understood as a sort of metaphysical symmetry--a principle about which transformations of the non-fundamental ontology leave the fundamental ontology unchanged. Determinism--a core scientific concept easily formulated in absolutist terms--is more difficult for the comparativist to define. After settling on the (...) most plausible comparativist understanding of determinism, I offer some examples of physical systems that the comparativist must count as indeterministic although the relevant physical theory gives deterministic predictions. Several morals are drawn. In particular: comparativism is metaphysically contingent if true, and it is most natural for a comparativist to accept an at-at theory of motion. (shrink)

Contemporary theories of consciousness are based on widely different concepts of its nature, most or all of which probably embody aspects of the truth about it. Starting with a concept of consciousness indicated by the phrase “the feeling of what happens” (the title of a book by Antonio Damásio), we attempt to build a framework capable of supporting and resolving divergent views. We picture consciousness in terms of Reality experiencing itself from the perspective of cognitive agents. Each conscious experience is (...) regarded as composed of momentary feeling events that are combined by recognition and evaluation into extended conscious episodes that bind cognitive contents with a wide range of apparent durations (0.1 secs to 2 or more secs, for us humans, depending on circumstances and context). Three necessary conditions for the existence of consciousness are identified: a) a ground of Reality, envisaged as an universal field of potentiality encompassing all possible manifestations, whether material or 'mental'; b) a transitional zone, leading to; c) a manifest world with its fundamental divisions into material, 'informational' and quale-endowed aspects. We explore ideas about the nature of these necessary conditions, how they may relate to one another and whether our suggestions have empirical implications. (shrink)

The American Medical Association enacted its Code of Ethics in 1847, the first such national codification. In this volume, a distinguished group of experts from the fields of medicine, bioethics, and history of medicine reflect on the development of medical ethics in the United States, using historical analyses as a springboard for discussions of the problems of the present, including what the editors call "a sense of moral crisis precipitated by the shift from a system of fee-for-service medicine to a (...) system of fee-for-system medicine, better known as 'managed care.'" The desire to minimize the number of individual new entities postulated is often referred to as quantitative parsimony. Its influence on the default hypotheses formulated by scientists seems undeniable. I argue that there is a wide class of cases for which the preference for quantitatively parsimonious hypotheses is demonstrably rational. The justification, in a nutshell, is that such hypotheses have greater explanatory power than less parsimonious alternatives. My analysis is restricted to a class of cases I shall refer to as (...) additive. Such cases involve the postulation of a collection of qualitatively identical individual objects which collectively explain some particular observed phenomenon. Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

Reflecting on her recent work concerning state violence in Israel-Palestine, Judith Butler explores the potential of religious perspectives for renewing cultural and political criticism, while Jürgen Habermas, best known for his seminal conception of the public sphere, (...) thinks through the ambiguous legacy of the concept of "the political" in contemporary theory. Charles Taylor argues for a radical redefinition of secularism, and Cornel West defends civil disobedience and emancipatory theology. BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. Recommender Systems (RecSys) have been around since the early days of the Internet, helping users navigate the vast ocean of information and the increasingly available options that have been available for us ever since. The range of tasks for which one could use a RecSys is expanding as the technical capabilities grow, with the disruption of Machine Learning representing a tipping point in this domain, as in many others. However, the increase of the technical capabilities of AI-powered RecSys did not (...) come with a thorough consideration of their ethical implications and, despite being a well-established technical domain, the potential impacts of RecSys on their users are still under-assessed. This paper aims at filling this gap in regards to one of the main impacts of RecSys: personal autonomy. We first describe how technology can affect human values and a suitable methodology to identify these effects and mitigate potential harms: Value Sensitive Design (VSD). We use VSD to carry out a conceptual investigation of personal autonomy in the context of a generic RecSys and draw on a nuanced account of procedural autonomy to focus on two components: competence and authenticity. We provide the results of our inquiry as a value hierarchy and apply it to the design of a speculative RecSys as an example. (shrink)

El artículo pretende analizar, a través de la historia, la cuestión de la patologización trans*, que ha contado y cuenta con una oposición bastante amplia por parte de diversos colectivos. El debate político de la cuestión (por medio de la petición de normativas y leyes que regulen determinados aspectos de la identidad) hace que una cuestión individual como es la identidad haya pasado a ser un tema colectivo. Que sea asunto colectivo hace que sea imposible desligar la biología de la (...) medicina, el derecho o la política. Es esta interdisciplinariedad lo que dota hoy en día a la cuestión trans* de tanta relevancia, tampoco exenta de polémica con otros movimientos sociales, como las redes sociales han venido mostrando últimamente. No obstante, es la gran visibilidad que ha obtenido por diferentes medios la cuestión trans* lo que la hace susceptible de múltiples análisis, que, como se ha dicho anteriormente, no se limitan a una única disciplina o a un único punto de vista. In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own.
